Can a court-ordered Guardianship be used in place of a Power of Attorney? Yes, as long as the guardianship document includes language about managing the person's estate.

What is the difference between a General and Special Power of Attorney? Both a General and Special Power of Attorney can be used to authorize someone to act on your behalf. However, the document must contain specific language referencing retirement plans. For example, if a Special POA states "cannot make decisions on my retirement plan," we would not be able to release information to the agent.
